ExpertiseConducting commercial litigation, particularly in the Commercial Court, and international arbitration, both ad hoc and in accordance with various rules (UNCITRAL, ARIAS, LCIA).
He is very experienced at handling matters involving an international or cross-border element including presenting foreign legal issues before tribunals in England.
Advising insurance and reinsurance companies, Lloyd's syndicates and intermediaries in litigation, mediation and arbitration with particular expertise in Bermuda form arbitration, energy risks (including property and business interruption), general liability and professional liability (including E&O and D&O).
He contributed the chapter on the Bermuda form to The Reference Handbook on the Comprehensive General Liability Policy, published by the American Bar Association in 2010. He has been recognised as a leading insurance lawyer by Intelligent Insurer (2009).
He was vice chair (and Head of the Legislative Sub-Committee) of the Insurance Coverage Section of the Tort Trial and Insurance Practice Group of the American Bar Association.
He is a regular external speaker at webinars, seminars and conferences, including for the Chartered Insurance Institute, Brokers & Reinsurance Markets Association, American Bar Association/Tort Trial and Insurance Practice Group, The Einstein Network Law Channel and Falconbury.
ExperienceRecent cases include:
- Acting in Commercial Court litigation in relation to several disputes over derivative contracts
- On and offshore energy related reinsurance claims by a captive insurer arising out of Hurricane Katrina
- Advising reinsurers on the operation of clash cover in the context of Insolvency Practitioner Bonds
- Representing London market excess insurers on professional liability claims from delays to the construction of energy plants
- Advising a Syndicate on foreign and UK proceedings brought in relation to reinsurance commutations
- Acting in relation to a Professional Indemnity / D&O / Crime policy claim relating to trading losses
- Advising in relation to D&O coverage arising out of investments in the sub-prime mortgage markets in the US
Although much of his work is in private and international arbitration, decided cases have included the House of Lords decision in HIH Casualty & General Insurance Ltd and others v. Chase Manhattan Bank [2003] UKHL 6.
